MANILA, Philippines – Several lawmakers and the Families of Victims of Involuntary Disappearance (FIND) have filed a petition before the Supreme Court against the scheduled interment of the late strongman Ferdinand Marcos at the Libingan ng mga Bayani.

Albay First District Representative Edcel Lagman, principal author of the Republic Act 10368 or the Martial Law Victims Reparations Act, represented FIND in the petition filed Monday afternoon, August 15.

Families of victims of enforced disappearances during Martial Law have joined former political detainees in asking the Supreme Court to prevent the burial of the late President Ferdinand Marcos at the Libingan ng mga Bayani (LNMB) in Taguig City.

The Families of Victims of Involuntary Disappearance (FIND) urged the high court on Monday to issue a temporary restraining order on the planned burial in September because the petition would be rendered moot with the interment of Marcos at the heroes' cemetery.

Ifugao Rep. Teddy Baguilat and the small opposition bloc in the House of Representatives will ask the Supreme Court to remove Quezon Rep. Danilo Suarez as their minority leader.

Baguilat insisted he was robbed of the post that he won after garnering the second highest number of votes in the election for speaker of the House on July 25 that was predictably won by Davao del Norte Rep. Pantaleon Alvarez, a close ally of President Duterte.

Baguilat said Suarez, despite placing third in the voting, should be part of the majority coalition since he voted for Alvarez.

In a press conference, Albay Rep. Edcel Lagman said he will file the petition in the high tribunal later this month.

“The petition will be to effectively nullify Suarez’s minority leadership and to recognize Cong.  Baguilat as the authentic, real and legitimate minority leader because he was the clear runner-up to Speaker Alvarez,” Lagman said.

The plenary session yesterday, 15 August 2016, confirmed the following:

  1. The formal coronation by the super majority of its chosen “minority leader”, Rep. Danny Suarez.

  2. The sinister plot of herding some members of the majority to abstain from the speakership contest and be considered as members of the minority, instead of as independent Members of the House as provided for in the last paragraph of Section 8, Rule 2.

  3. The pendulum allegiance of those who abstained and erroneously considered as minority members and who subsequently returned to their “mother ship” in the majority coalition after “electing” a minority leader.

  4. The flawed process of applying from the majority to the minority and from the minority to the majority by submitting all of the applications to the Speaker and/or the majority leader contrary to the provisions of the Rules wherein one from the majority who wishes to align with the minority must apply with and secure the consent of the Minority Leader, not the Speaker or Majority Leader.

  5. The unauthorized “election” of Rep. Danny Suarez as “minority leader” by the group of “abstentionists” who had no authority to call for a special election of the minority leader, much more elect a minority leader.

  6. The ascendancy of numbers over reason and logic and the predisposition of the super majority in stifling a small but authentic minority.

It is now the turn of the families of desaparecidos or enforced disappearance victims to ask the Supreme Court to junk now and forever the projected burial of the remains of President Ferdinand E. Marcos in the Libingan ng mga Bayani (LNMB)

The Families of Victims of Involuntary Disappearance (FIND), represented by Rep. Edcel C. Lagman and Nilda L. Sevilla, Honorary Chair and Co-Chair of FIND respectively, filed the Petition for Prohibition dated August 15, 2016 with the Supreme Court on Monday afternoon which is docketed as G.R. No. 225984.
