An independent fact-finding commission wholly composed of retired justices must be formed to thoroughly investigate the reported inordinate extrajudicial killings by the so-called “Davao Death Squad”, determine the identities of the principals and perpetrators as well as those of the victims.

The commission must be created forthwith by President Rodrigo Duterte.

The inquiry must not be left to politicians whose motives could always be suspect despite their avowal of impartiality.

There are a number of precedents where fact-finding commissions were created to investigate events of transcendental importance like the Agrava Commission, Feliciano Commission and Melo Commission.

The Agrava Commission investigated the Benigno Aquino assassination on February 21, 1983, the Feliciano Commission conducted an inquiry on the Oakwood mutiny on July 21, 2003 purportedly raising grievances against the Arroyo administration and the Melo Commission probed human rights violations, including extrajudicial and political killings, circa 2004-2006.

The Agrava Commission headed by Justice Corazon Agrava was created by former President Ferdinand Marcos despite allegations that he masterminded the Aquino assassination.

Former President Gloria Macapagal-Arroyo established the Feliciano Commission headed by Justice Florentino Feliciano, and the Melo Commission headed by Justice Jose Melo to investigate media and activist killings during her administration.

I vote in favor of House Bill No. 3504 on account of the following reasons:

  1. The Constitution does not fix the term of office of elected barangay as well as Sangguniang Kabataan officials. Their term of office is provided by law. Consequently, the Congress can amend the pertinent law on the date of election of barangay and SK officials under the principle that Congress does not pass laws which it cannot repeal, amend or modify.

  2. The rescheduling of the barangay and Sangguniang Kabataan elections from 31 October 2016 to 23 October 2017 is not an extension of the terms of these village and youth officials. When voters elected the incumbent barangay officials in 2013, they were fully aware, as they are presumed to know, that under Republic Act No. 9164, while the term of office of the barangay officials is three years, they shall “remain in office … until their successors shall have been elected and qualified.” Hence, there is an automatic holdover provision which is not deemed as a term extension but is a policy to avoid disruption of public services and prevent a void in the position of concerned officials.

  3. Incumbent barangay officials are entitled to the presumption of regularity in the performance of official functions as well as the presumption of innocence until the contrary is proved. Consequently, barangay officials who are suspected to be errant or involved in drug trafficking enjoy these presumptions but they can be prosecuted and convicted if the evidence warrant. But there can be no removal, like their replacement, prior to a final determination of their respective culpabilities.

  4. There is no provision in HB No. 3504 that incumbent barangay officials after 31 October 2016 can be replaced by those appointed by the President, through the Department of the Interior and Local Government.


For all the foregoing reasons, I cast an affirmative vote.

Albay Rep. Edcel Lagman on Tuesday said President Rodrigo Duterte is the last person to have the moral ground in appealing for mercy for Filipina convicted drug courier Mary Jane Veloso, who is on temporary reprieve from death row in Indonesia.

In a press briefing at the House of Representatives, Lagman cited the irony in Duterte telling Indonesian President Jokowi Widodo that he would respect the judicial process in Indonesia, when Duterte could not even respect due process in his own country amid his administration’s war on drugs.

Albay Rep. Edcel Lagman on Tuesday flatly denied that the Liberal Party is acting like a “Trojan horse” out to plot an impeachment complaint against President Rodrigo Duterte.

In a press briefing of the minority bloc at the House of Representatives, Lagman said it is Duterte himself who is causing his inevitable impeachment due to his careless statements that strain the country’s alliances with other countries.

When President Rodrigo Duterte openly shared the gossip about Senator Leila de Lima’s relationship with her married driver-bodyguard, bills legitimizing divorce were filed in Congress.

Although the filing was not purposely timed to highlight the gossip, it nevertheless underscored the need for a serious consideration of the bill this time, given the status of people in high positions in government who are embroiled in legal and moral problems over their marital relationships.

Perhaps under this administration, logic and reason will prevail and a divorce bill will finally become law to put an end to the hypocrisy of the societal norms and practices related to marriage.
