Whether directly with China or indirectly with its corporate alter ego, any joint exploration in the country’s exclusive economic zone (EEZ) in the West Philippine Sea violates the Constitution and diminishes Philippine sovereignty.

Paragraph 2 of Section 2 of Article XII of the Constitution unequivocally provides that the “State shall protect the nation’s marine wealth in its archipelagic waters, territorial seas and exclusive economic zone and reserve its use and enjoyment exclusively to Filipino citizens.”

The seven associate justices who unconstitutionally attempted to oust Chief Justice Maria Lourdes Sereno must recuse themselves or inhibit from the adjudication of the quo warranto petition which is expected to be filed by Solicitor General Jose Calida questioning the validity of Sereno’s appointment.

The new tack against Supreme Court Chief Justice Maria Lourdes Sereno is a quo warranto petition in tandem with an impeachment trial before the Senate.

This double-barrel assault against the chief magistrate is bound to boomerang because there are no credible and concrete impeachable offenses against Sereno, while the one-year prescriptive period for filing an action for quo warranto has long prescribed pursuant to Section 11 of Rule 66 of the Rules of Court.

Any quo warranto petition questioning the authority or basis for Chief Justice Maria Lourdes Sereno to hold the position of chief magistrate is doomed to fail.

This is so not only because her appointment is valid and legal, but the action for quo warranto has long prescribed.

The “mutiny” reportedly spearheaded by seven (7) associate justices of the Supreme Court against Chief Justice Maria Lourdes Sereno diminishes the respect owing to them and tarnishes their dignity even as they placed the High Court in an inordinately bad light.

Instead of waiting for the Chief Magistrate to be impeached by the House of Representatives and tried by the Senate, pursuant to the Constitution for alleged “impeachable offenses”, the concerned justices compelled Sereno to take an indefinite leave after a failed attempt to unseat or remove her.
